Maui Vision Properties LLC, Maui Vision Rentals (MVR) Cancellation and Rental Policies

 

Cancellation Policy: In case of cancellation by the Renter/Guest (Guest), Cancellation must be

received in writing/e-mail. Furthermore, no credit shall be given for late arrivals or early departures. We strongly recommend that you purchase travel insurance, in case your plans change or you cannot travel. Depending on which booking platform you booked, the refund, if any, do vary.  Do read the check-in email sent or the property web page from where you booked for additional details.

Rental Rules: Guest agrees to abide by the Rental Rules.  Guest shall cause all members of the rental party and anyone else Guest permits on the property to abide by the following rules at all times while at the property including rules posted at the condominium complex.  By accepting this reservation and paying for the rental, guest enters the condo agreeing to all terms and conditions of this agreement and accepts responsibility for all guests of the property.

Guest shall not permit any use of the pool by unsupervised children.  An adult Guest must accompany children and be present at all times. Guest and other invitees shall use the pool at their own risk.  Please respect the posted rules.

Mandatory Occupancy Disclosures: You must disclose to us the exact number and names of guests (subject to maximum) who will be occupying the Property during the rental term.  You must immediately notify us, by phone and in writing, if the number of occupants changes.  Additional charges may apply.  People other than those in the Guest party as established upon reservation may not stay overnight in the property. Any other person invited on the property is the sole responsibility of Guest. Guest may not sublet or assign this rental agreement.  The Property shall be used for residential vacation rental purposes only.  Special events such as parties, receptions and other group events are not permitted without our express written consent.  Guests who refuse to adhere to this policy will forfeit any security deposit paid and or we reserve the right to bill for financial losses.  

Guest shall be liable for all acts of the family, employees, or other persons invited on to the property. All loud noise from stereo by Guest or invitees must be non-offensive and kept to a minimum or low volume at all times. Some resorts do not allow any kind of music, radio, or stereos in the common areas.  Do follow the posted rules at your rental complex.  Quiet time is between 9 PM HST and 8AM HST.

Occupancy and use of premises and communal areas shall not be such as to disturb other guests or residents. The Owners Agent has the right of entry to inspect the property at times Owner and Agent deems necessary. The Agent has the prerogative to terminate this agreement and direct disruptive guests to vacate premises without issuing refunds.

All of the units are privately owned; the Homeowners are not responsible for any accidents, injuries or illness that occurs while on the premises or its facilities. The Homeowners are not responsible for the loss of personal belongings or valuables of the Guest or invitees. By accepting this reservation, it is agreed that all Guests are expressly assuming the risk of any harm arising from their use of the premises or others whom they invite to use the premise. 

Condition of Property: The property and contents are privately owned, with Maui Vision Rentals acting solely as the Owner’s Agent.  The Property is rented with Owner’s furnishings and neither Owner nor Agent will be responsible for providing any additional furnishings or equipment.  No items belonging to Owner shall be removed from the Property.  Do not take linens and bath towels from the units. The exception to this would be beach towels, beach chairs, or beach equipment.  Please take care to return beach items for the next Guest.  Guest agrees to keep the Property in good, clean condition.  Guest shall not remove or rearrange inside furniture.  Upon departure, for properties with a washer and dryer inside the unit, the guest is expected to wash dirty towels and bed sheets.  Guest is to wash dishes, and take out the trash.

Housekeeping:  There is no daily housekeeping service. While linens and bath towels are included in the unit, maid service is not included in the rental rate. The housekeeper provides a starter supply of soaps and paper products.  Additional supplies that may be needed are your responsibility to purchase.  If you believe something in the Property was not adequately cleaned, notify us and we will send a housekeeper to re-clean it.  We do not offer refunds or adjustments for housekeeping problems.

Guest is not expected to clean but dishes shall be washed or put in the dishwasher, garbage and discarded items shall be properly bagged to avoid spillage or leakage. And keys to pool (and/or condo) shall be left in the specified departure location

Please make sure that all windows, sliding glass lanai door and front door are securely locked whenever you leave the condo. 

Insects:  Hawaii is a tropical climate and has a diverse ecosystem.  Insects are a part of that system.  We try to control this natural occurrence by regularly spraying for insects.  The most common pests that may find their way into the Property include ants, small beetles, gnats, mosquitoes, geckos, and even cockroaches.  Keep the front door and lanai screen doors closed snug behind you whenever entering or leaving the condo.  We do not offer refunds or adjustments for pest control issues.  You can read more about our native insects here:  https://www.insectidentification.org/insects-by-state.asp?thisState=Hawaii

Access: Guest shall allow Homeowner or Agent access to the property for purposes of repair and inspection. Homeowner or Agent shall exercise this right of access in a reasonable manner.  Equipment occasionally malfunctions and cannot be guaranteed 100% of the time. We will correct the problems as soon as humanly possible. An authorized employee or repairman may enter the premises to repair such equipment. Refunds will not be issued due to malfunctioning equipment including Internet access. This applies to any closed amenities such as pools, BBQs, etc.

Smoking: All properties including condominium lanais (balcony), hallways, and public areas within the State of Hawaii are smoke-free at all times.  This includes e-cigarettes and vaping. There is a $200-$450 fine. Smoking is only allowed outside in designated area. 

Pets are NOT allowed in any of our properties – violators are subject to immediate eviction.  The exception: legally certified service and emotional therapy animals with proper documentation and application with front office.  Documents must be pre-approved for your service/emotional animal before being allowed to rent.

 Damage and Security Deposits: Guest authorizes us to repair damages or losses caused by you and/or your invitees at your expense and you accept responsibility for the acts of your children, visitors, or invitees. You agree to the following charges for damages and losses, as applicable:

  1. Unusual damage or dirtying of premises (such as, but not limited to, defacement of walls or furniture, partial or total destruction of walls, landscaping, fixtures or furniture, breakage, flooding or fire due to negligence or willful misconduct, plumbing blockage resulting from misuse of facilities, and everything else requiring cleaning, replacement or repair in excess of normal housekeeping) at estimated cost of cleaning, repair and replacement
  2. Theft or misplacement of household goods including linens, appliances, utensils, furnishings, artwork and electronics, at estimated cost of replacement
  3. Lost keys at a fixed charge of $200, as locks will need to be changed
  4. Damage to or loss of one item in a set (for example, twin bedspreads or a matching pair of lamps) may result in charges for replacement of the entire set if a matching replacement is unavailable.

NOTICE:  Due to our experience with the recent 2019/20 COVID-19 virus, please know it is dependent on you to make sure your trip is covered.  No matter the situation, unforeseen events, including storms, missed flights, or revised airline schedules that may cause changes to Guest’s dates.  We cannot control the weather and no refunds for humidity, rain, or warm weather etc.  Cancelations of flights as mandated by government authorities that are beyond our control, Maui Vision Properties LLC and condo owners are not responsible.  In the event of a no show, shortened stay or cancelled booking, no refunds shall be made.  Please purchase trip insurance to protect your vacation.  We can recommend a provider as an option or use your own preferred insurance broker.  Many insurance providers offer a “cancel for any reason” type policy that will cover you in any situation and for any reason.  Please remember that any policy you purchase is time sensitive from the date you purchase and your stay dates. Please ask your insurance provider about this type of policy and make sure you are purchasing the correct one as well as asking questions to determine how and when your coverage begins.  Mahalo for doing your part to protect your trip. 

Damage Waiver Program:  Our properties and their contents are valuable and reasonable care should be taken with them during their rental. The Damage Waiver Program that reimburses certain costs for unintentional accidental damage to our properties during their rental occupancy. “Guest” means only those persons registered or booked to share the same accommodations, We charge guests a non-refundable Damage Waiver Fee upon booking to defer our costs for Guest participation. If, during a guest’s occupancy, guest or a member of guest’s party or guest’s guest causes any damage to real or personal property of our rental property as a result of unintentional accidental acts or omissions, guest must notify our property management office at that time, and before check-out.

When reported immediately, it covers the registered guest against the accidental damage to the unit or its contents for an amount not to exceed $500.00 US dollars.  Unless the damage is with intent or reckless, then the guest will be liable for half or all cost of damage.  For rentals that exceed the coverage limits of the Program, Guest is liable to us for any damages caused by guest or a member of guest’s party or guest’s guest that are not reimbursed to us or exceed the maximum per-incident limit of our coverage, and the credit card on file and/or Guest will be billed the additional charges.

  • This plan is provided and administrated by Maui Vision Properties LLC and is not an insurance policy.
  • Damage caused by acts of violence or malicious acts will not be covered.
  • Damage is limited to the rental unit you are occupying under the terms of your confirmation and does not cover any other structure.
  • Coverage includes the interior of the unit including furnishings, appliances and other fixtures.
  • Guest’s personal items such as luggage, clothing, electronics or any other items that are not a part of the rental property are not covered under this Program. Theft of any kind is not covered.
  • Vehicles of any kind are not covered.
  • Acts of God are not covered.
  • Damage or loss caused by pets or any animal brought onto the premises is not covered.
  • The damage plan does not cover the loss of use of the property.
  • The damage plan takes effect on the date and time of check-in and terminates at 11:00 am the day of check out or at the time of guest departure whichever occurs first.  
  • Guest agrees in the event that legal action is required for the enforcement of this plan that all disputes will be settled by arbitration.

Owner and Agent reserve the right to correct errors in pricing and amenities. 

Late Check-out / Early Arrival: If you need a late check-out or early check-in, please get Agent approval in writing before you arrive on Maui. If we can accommodate your request we will.  If you need a much earlier check-in or check-out we can guarantee a window of time there is a small charge for this privilege.

Maintenance:  Regular maintenance is performed on the Property; however, as with all homes, malfunctions may occasionally occur. You agree to report PROMPTLY to us at the telephone numbers shown on the Guest Confirmation any mechanical, electrical, plumbing or other problems with the Property.  Damages resulting from delayed reporting will be charged against any security deposit paid and/or billed to Guest.  Should any major equipment be out of order, we will correct the deficiency as soon as possible during normal business hours.  We do not offer refunds or adjustments for mechanical malfunctions or maintenance problems.  

Neighboring Construction: Occasionally some properties may experience noise from construction at nearby properties.  These situations are not within our control and we are rarely notified in advance.  There will be no refunds or adjustments in these situations.

Rules, Regulations and Laws: Guest shall permit no activities on the premises that are contrary to any law, ordinance, homeowner association rule, and/or any applicable health and/or fire department or insurance policy provisions.

Subject to Change: Advertised amenities are subject to change without notice or compensation.  Changes can occur after a reservation is made as a result of sale of unit, remodeling, mechanical failure or servicing.  Should the Property be made unavailable for any reason beyond our control, we may substitute another like property.  If no other property is available the limit of liability by property Owner or Agent is to refund any prepaid rents that have been paid by the registered Guests.

Non-Liability and Indemnification of Owner and Agent: GUEST AGREES TO HOLD HARMLESS AND INDEMNIFY THE OWNER AND AGENT FROM ANY AND ALL COSTS, EXPENSES, LEGAL PROCEEDINGS, LEGAL FEES, SUITS, CLAIMS OR DEMANDS, WHETHER FROM LOSS OF LIFE OR INJURY TO GUEST AND/OR INVITEES OF GUEST OR LOSS OF OR DAMAGE TO GUEST’S PERSONAL PROPERTY, UNLESS SAME WAS DUE SOLELY TO THE WILLFUL ACT OR GROSS NEGLIGENCE OF THE OWNER OR AGENT.  You are welcome to use any beach supplies and recreational equipment at your own risk and provided that, you will assume all liability associated with the use of these items.

Safety:  Guest safety is our highest priority.  Be mindful of changing surf conditions, currents and rapid changes in weather patterns.  Strong and dangerous conditions and rogue waves can and do happen and can be fatal.  Guest understands that all of our condos and properties are not “child-proof.”
